This agreement sets out what you may and may not do with source code delivered by BLESSED LOGIC SYSTEMS S.R.L.. It applies to every deliverable unless a separate written agreement replaces it.
1. The licence granted
On full payment, or, for a package offered free of charge, on download, the Provider grants the Client a perpetual, worldwide, non-exclusive, non-transferable licence to use, modify and compile the delivered source code for the purposes described below. The licence cannot be revoked except in the circumstances set out in section 6. Free packages carry exactly the same restrictions as paid ones: free to use, not free to redistribute.
This page is the licence. It applies to every deliverable from the moment of delivery, whether or not a copy of this text is included in the files you receive. Delivered archives are not required to carry a licence file, and usually will not: the version published here is the authoritative one, it is the version referenced in the order confirmation, and the version in force is the one published on the date your order was confirmed. A copy is provided in writing on request.
2. Scope of use
Unless the order confirmation says otherwise, the licence covers:
- use of the deliverable within one project operated by the Client, including its test, staging and production environments;
- modification of the source code to fit that project, including adaptation to a different engine version;
- compilation and deployment of the resulting binaries on infrastructure the Client controls;
- disclosure of the source code to the Client's own staff and contractors, provided they are bound by equivalent confidentiality obligations.
A licence covering additional projects, or a full transfer of rights, is available and is quoted separately. Ask before the order, not after.
3. What is not permitted
- Redistribution. The source code may not be resold, sublicensed, published, leaked, shared on forums or file services, or otherwise made available to anyone outside the scope in section 2, whether or not money changes hands.
- Derivative products for sale. The deliverable may not be repackaged, renamed or bundled and then sold or given away as a product, in original or modified form.
- Removal of attribution. Copyright notices contained in the delivered files may not be removed or altered. They do not appear anywhere a player can see.
- Use in an unlawful project. The deliverable may not be used in a project that infringes third-party rights or breaches applicable law.
4. Ownership
The Provider retains ownership of the intellectual property in catalogue and commissioned deliverables and in the reusable components, libraries, patterns and tooling they are built from. The Client owns the modifications the Client makes to delivered code, and owns outright any material the Client supplied.
Where an order expressly includes a transfer of rights, that transfer is recorded in writing in the order confirmation and takes effect on full payment. In the absence of such wording, this licence applies.
5. Third-party components
If a deliverable incorporates third-party open-source components, they are identified in the delivery documentation together with their licences, and those licences govern those components. The Provider does not deliver material belonging to a third party without the right to do so. The Client is responsible for the licence status of the wider software the deliverable is integrated into.
6. Termination
The licence terminates automatically if the Client redistributes the source code in breach of section 3, or raises a chargeback on a paid and delivered order without first contacting the Provider. On termination the Client must cease using the deliverable and delete all copies. Termination does not entitle the Client to a refund and does not limit any other remedy available to the Provider.
7. Warranty and liability
The deliverable carries the warranty described in the Refund & Warranty Policy. Beyond that warranty, and to the extent permitted by law, the code is provided as it stands. The liability limits in clause 13 of the Terms of Service apply to this agreement as well.
8. Support and updates
Installation support is included as described in the Terms of Service. Future versions of a catalogue package are not automatically included; where an update is offered to existing licensees, it is offered at the Provider's discretion or on the conditions stated at the time of purchase.
9. Governing law
This agreement is governed by Romanian law and is read together with the Terms of Service. Copyright in the delivered source code is protected as a computer program under Legea nr. 8/1996 privind dreptul de autor și drepturile conexe, which also defines the acts a lawful user may perform without the rightholder's authorisation. Nothing in this agreement restricts those statutory acts. If any provision is found unenforceable, the remainder stays in force.
